Introduction

This privacy policy sets out how Rebecca Stockley, CEO of Rock Solid Counselling uses and protects any information that you provide.  I am committed to ensuring that your privacy is protected under the Data Protection Act (2018) following GDPR.  Any personal data will only be used for the purpose that is stated within this privacy policy.  If any other purpose is required you will be informed and asked consent for data to be used for another purpose. 

This policy will be updated as required from time to time.   This policy is effective from 1st September 2024.

I currently collect and process the following information should you choose to submit it through the contact form on my website.  This includes:

Purpose of collecting data

The purpose of collecting data is to ensure that I have basic details so that you are contactable and I can reply to your enquiry.  This is the minimum necessary data required and I will delete the data after 1 year or sooner.  Should you enter into a counselling contract, the full Privacy Policy is below.

What information I collect, use, and why

I collect or use the following information to provide counselling services:

  • Name, address and contact details
  • Gender
  • Date of birth
  • Emergency contact details
  • Health information (GP surgery, including medical conditions, allergies, medical requirements and medical history, if relevant)
  • Information about care needs (including disabilities, home conditions, medication and dietary requirements and general care provisions). This information may be collected for those clients that I attend Home Visits for as part of a risk assessment.
  • Payment details (including card or bank information for transfers and direct debits)
  • Records of meetings and decisions (notes will be stored in a locked box)
  • Call recordings (Any telephone phone conversations between sessions will be briefly documented)

I also collect the following information to provide client care and Counselling services:

  • Racial or ethnic origin
  • Religious or philosophical beliefs (this may be important in the counselling process, should client wish to discuss any spiritual or philosophical issues – this will be optional and guided by what the client wishes to disclose and discuss)
  • Health information (only information if it is relevant to the counselling process).

I collect or use the following information for safeguarding or public protection reasons:

  • Name, address and contact details
  • Emergency contact details
  • Health information (GP surgery, including medical conditions, allergies, medical requirements and medical history)
  • Information about care needs (including disabilities, home conditions, dietary requirements and general care provisions)

How long I keep information

I keep your personal information for as long as necessary to fulfil the purposes outlined in this privacy notice unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements).  No purpose in this notice will require me to keep your personal information for longer than 3 years.

When I have no ongoing legitimate business need to process your personal information, I will either delete or anonymise such information, or, if this is not possible (for example, because your personal information has been stored in backup archives) then I will securely store your personal information and isolate it from any further processing until deletion is possible. 

Who I share information with

Others I potentially share personal information with are:

  • Other health providers (eg GPs and consultants)
  • Organisations I need to share information with for safeguarding reasons
  • Emergency services
  • Organisations I am legally obliged to share personal information with.

 NB. I will not share your personal information with any third parties unless I have your permission or have a legal obligation to do so.

Duty of confidentiality

I am subject to a common law duty of confidentiality. However, there are circumstances where we will share relevant health and care information. These are where:

  • you’ve provided me with your consent (I have taken it as implied to provide you with care, or you have given it explicitly for other uses);
  • I have a legal requirement (including court orders) to collect, share or use the data;
  • on a case-by-case basis, the public interest to collect, share and use the data overrides the public interest served by protecting the duty of confidentiality (for example sharing information with the police to support the detection or prevention of serious crime);
  • If in England or Wales – the requirements of The Health Service (Control of Patient Information) Regulations 2002 are satisfied; or
  • If in Scotland – I have the authority to share provided by the Chief Medical Officer for Scotland, the Chief Executive of NHS Scotland, the Public Benefit and Privacy Panel for Health and Social Care or other similar governance and scrutiny processes.
